Treated unfairly by your HOA? Victim of selective enforcement? If you live in an HOA, it is absolutely essential to know HOA laws and understand your rights. These institutions of private government often can (or at least try to) control countless aspects of your daily life: where you can park your car, what kind of landscaping or architectural features you can have, what color you can paint your house, etc. Many are not aware of their responsibilities. Even fewer know their rights.
Our diverse real estate litigation practice includes representation landlords and tenants, buyers and sellers, borrowers and lenders, realtors, and homeowners. Our lawyers represent individuals, families, companies, and others who find themselves enmeshed in real estate disputes. We have handled hundreds of real estate lawsuits, in both federal and state court, including eviction actions, Fair Housing Act lawsuits, neighbor disputes, and non-disclosure cases.
A personal injury can change your life (and the life of your loved ones) in a matter of seconds. Car accidents, animal attacks, slip and falls, and wrongful death cases present unique challenges for those who have been impacted. Accidents and personal injuries can be very stressful. Our Phoenix personal injury lawyers are committed to helping you through this process with as little added anxiety and aggravation as possible. Call us today to speak with an attorney.
Consumer rights are an important issue in today’s world. In a society where money means power, consumers and small businesses often get treated unfairly. Federal and state laws provide important protections for consumers that, if violated, may entitle you to compensation. These include the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, and the Telephone Consumer Protection Act, to name just three of the many laws that exist to protect consumers. We provide aggressive, effective representation to consumers whose rights have been violated.
We regularly represent both employees and employers in our labor and employment practice. Our attorneys are well versed in employee contract disputes, wage disputes, overtime and minimum wage claims, non-compete and confidentiality agreements, whistleblower lawsuits, and sexual harassment, discrimination, and wrongful termination cases. We are experienced in litigating cases filed under the Americans with Disabilities Act (“ADA”), the Family Medical Leave Act (“FMLA”), Title VII of the Civil Rights Act, and other state and federal employment laws.
The Dessaules Law Group handles all sides of insurance coverage disputes and insurance defense law. Our dedicated attorneys provide insurance defense litigation in Arizona as well as representation in coverage and bad faith cases. Our experienced trial attorneys have successfully resolved countless insurance disputes by way of negotiation, mediation, litigation, trial, and arbitration. Although we will work hard to prevent costly and time-consuming litigation, our attorneys are prepared and will not hesitate to pursue justice through the court system.
Our lawyers are experienced trial lawyers and litigators who handle every aspect of a case, from inception through trial and appeal. Statistically, most lawsuits will settle before trial. However, many lawyers all too often make the mistake of playing these odds and, as a result, can find themselves unprepared for trial. We believe that preparing every case for trial often gives us stronger leverage in settlement discussions. Although many clients hire us at the beginning of a case, we are also frequently asked to take over an existing case for another lawyer.
“Business law” is a term covering a variety of business-related legal disputes, including partnership and shareholder disputes, contract disputes, and a host of other business conflicts. If you own a business or have a dispute with a business, we can help. And no matter if you are a large business or small business, it is vital to have quality legal representation to ensure your business is protected. Our Phoenix business attorneys can assist businesses of all sizes, including small businesses, and their owners with any legal questions, concerns, or problems they may have.
ARBITRATION AND MEDIATION
Litigation can sometimes be costly, time-consuming, and complicated. Alternative Dispute Resolution (ADR), including arbitration and mediation, sometimes can provide an alternative to getting a case resolved in less time and for less money. ADR does not always have an “either-or” relationship with litigation. If your case is filed in court, you can expect to participate in some form of ADR before the case goes to trial. A judge may refer you to settlement conference or mediation or the case may be subject to compulsory arbitration based on the amount in controversy.
It is not an exhaustive list of every type of case we handle. Also, it is sometimes difficult to pigeonhole a case as many disputes overlap among two or more legal service areas. For example, an employment or business dispute may have intellectual property, defamation, or insurance coverage issues. Real estate disputes often can implicate bankruptcy or consumer rights. Feel free to read through some of our practice areas and then contact us to discuss your specific legal needs and concerns.
Dessaules Law Group is committed to meeting our clients’ objectives without breaking their budgets
Whether you are hoping to avoid going to court or you already in court, our lawyers will develop an appropriate results-oriented strategy of representation. We cannot guarantee outcomes (no lawyer can), but we will work diligently, efficiently, and effectively to achieve the outcome that is best for you and your case. We provide competent, diligent representation at all phases of a dispute: from sound pre-litigation advice and counseling (with the goal of successfully resolving a dispute before it goes to court); to skilled, effective representation in court; to patient and thorough handling of appeals.
Our philosophy is that, although not every case will go to trial, every case must be prepared as if it is going to trial. While many cases settle (with some fortunate enough to never have to be filed in the first place), we cannot predict which cases will settle or when. We will vigorously fight for you to make sure you are prepared and that we can achieve the best possible outcome.
